محتوا

Three legal queries (istiftā) regarding the “triple divorce” (sih ṭalāq), one of the forms of Islamic divorce. By pronouncing the ṭalāq formula three times in immediate succession, the divorce instantly takes effect. The questions are addressed to a judge (qāḍī) who is not mentioned by name. Each answer is written in short at the end of the question (and bold here). The answers to the question are written in a different hand, apparently that of the judge mentioned in the first question. The first two questions are positively answered.

Folio:
1 Praise to the One who deserves it 
2 What is the judgement of the qāḍī, the illustrious and knowledgeable imam [+/-4], 
3 of Islam and Muslims, the pride of the most virtuous, may God prolong his virtue, regarding [this]: [When] a man  
4 pronounces his triple divorce in one go, is the triple-divorce [principle] met, 
5 or not? What is the judgement, that they may receive recompense [in the afterlife], by the will of God. 
6 The triple divorce shall be valid. 
7 And, what is the judgement,  
8 if that man who pronounced the triple divorce in one go, 
9 then at the same time called the woman mother or sister, can he 
10 remarry her, or not? What is the judgement? 
11 The triple divorce shall remain valid. 
12 And God knows best. 
1 And, what is the judgement, 
2 [concerning a case where] a man gives the authority [to request a divorce] to his wife, and 
3 she pronounces the triple divorce [in one go?], is the divorce [valid], or not? What is the judgement? 
4 A response has been given. And God knows best.
