Content

Probably an excerpt from a treatise of legal questions sent to a certain faqīh called Muḥammad b. ʿAlī. This particular folio concerns a case of ownership and use of a garden. The text is partly illegible due to the paper’s poor state of preservation, and our readings are tentative.

Folio:
1 In the name of God, the Merciful, the Compassionate. What is the judgement of the faqīh, may God be pleased {} with him. A man bought a garden from [another] man. Then
2 he sold it to someone else. The one who bought it [last,] sold it to [yet] another person. {This garden} changed hands three times. This [man?] who then bought it [+/- 1]
3 went to the seller [+/-2] everyone refused. [+/- 2] {-/+1} The judgement of Muḥammad b. ʿAlī [+/- 1] was: Let me refer to
4 this statement by Muqātil on this subject (?): “He swore, ‘I did not raise my hand. [+/- 5 {}] When one swears an oath in Persian one doesn’t need to stand up for it. (?)
5 [+/-2] It is correct that everyone swears an oath that, “It was not me.” [+/- 6 {}]
6 He does not have a case. [Tell him: ?] “You have held the garden for three months. You shall return it.
7 This is chivalry in Islam.” {} One hundred thousand greetings to Khwāja ʿAlī, may God help him. Send my regards
8 to him.
