Legal query (istiftā) addressed to religious authorities. The questioner asks whether a seller of land can challenge the validity of the annulment (iqālat) of a sale with an agent (wakīl) acting on behalf of his sister’s son or daughter (khwāhar-zāda). The annulment met the following conditions: 1) the seller was mature and of sound mind; 2) it was conducted voluntarily; and 3) the payment was received from the agent. However, the sister’s son or daughter did not appear for the hearing. The response, authored by ʿUmar b. Muḥammad, denies the validity of the seller’s potential claim.

رحمکم الله 1
چگویند ایمه دین رضی الله عنهم اجمعین 2
[در آنچ (؟) ملک خرید + 1] خواهرزاده بعد ازان 3

Firuzkuh 21

[فـ]ـر[و]شنده و وکیل این بیع اقالت کردند برضای [یکدیگر (؟)] 4
[زمین؟] فروشنده بستد باز داد تا خواهرزاده این اقالت را ممکر   5
منکر نشود فروشنده را رسد کی با وکیل دعوی کند  6
کی این اقالت درست نیست زرمن باز ده چون فروشنده   7
بالغ و عاقل بوده است و این اقالت بطوع و رغبت کرده است  8
 و بها از وکیل بستده و انکار خواهرزاده درین معنی ظاهر نی  9
یا نی بیان فرمایند تا ثواب بود ان شا اللّه العزیز  10
نی اللّه اعلم  11

Translation

Firuzkuh 27

1 May God have mercy on you. 
2 What is the judgement of the imams of the faith, may God be pleased with them all
3 regarding someone who bought property on behalf of their sister's offspring. After that,

4 the seller and agent [mutually] agreed to annul this sale. [The buyer] 
5 took returned [the land] to the seller, to indicate that the sister’s progeny would not challenge the annulment. 
6 Could the seller make a [meritorious] claim against the agent,  
7 stating “the annulment is invalid, give me my money back,” -- [bearing in mind that] the seller is 
8 of age and sound mind, [acted of] their own volition and desire, and  
9 accepted the money [at the agreed price], [while] the niece was not present [for the hearing] on this matter -- or not? 
10 What is the judgement, that they may receive recompense [in the afterlife] by the will of God, the exalted
11 No. God knows best.  
12 It was written by ʿUmar b. Muḥammad.
